1. Web Design – one-time service
Payments
I’ll make the home page of the site first, after which I expect the first payment of half of the expected cost of the site.
The remaining payment for the website, along with any other services you may have used, can be made after the website has been completed.
You own the site immediately after it’s been fully paid for.
While I may own the site before it’s been paid for, you are still legally responsible for it and its content.
Service cancellation
If you choose to cancel the service part way through the website-build, you will be charged for any completed work. For example, if I have built 5 pages of a 20 page site when you decide to cancel, you will be charged for the cost of a 5 page site.
Termination
By failing to comply with any of my terms or pay outstanding fees, I reserve the right to suspend your website and my services.
I reserve the right to suspend or terminate any of the services I provide at my sole discretion and without notice.

2. Monthly Subscription Plan Terms
Payments
On all Pay-Monthly plans, you must commit to an initial 15-month contract. The first payment must be made after the home page of the site has been created. Payments can be made every 1, 3, 6 or 12 months.
I reserve the right to change the monthly price for my services any time after the initial 15-month period, or at any time (including the initial 15-month period) if the scale or complexity of the site changes significantly.
You only take ownership of your site after 36 months of payment.
While I may own the site before this point, you are still legally responsible for it and its content.
Service cancellation
You can cancel your subscription at any time, with one months notice.
If you choose to cancel your subscription during the initial 15-month contract, you must pay the outstanding cost of the remaining months in full. The site will be taken offline, and you can’t take the website files or databases to another hosting provider.
If you choose to cancel your subscription after the initial 15-month contract and during the first 36 months of the plan, you do not have to make any further payments. The site will be taken offline, and you can’t take the website files or databases to another hosting provider.
If you choose to cancel your subscription after the first 36 months of the plan, you do not have to make any further payments. The site will be taken offline, though you may migrate the website to another hosting provider, and can be provided with the website files and databases.
If you would like me to send you the website files and databases, but you haven’t paid for 36 months in total, you must pay the outstanding cost of the remaining months in full.
Termination
By failing to comply with any of the terms & conditions or failing to pay outstanding fees, I reserve the right to terminate or suspend your website and my services.
I reserve the right to change, suspend, or terminate any of the services I provide at my sole discretion and without notice.
Upon termination, I have the right to delete all files, data or information associated with the terminated services.
Development Time
You are entitled to one hour of free development time per month, after which any additional website development will be charged at my general rate.
Each month’s development time must be used within that month. Development time that has not been used within that month does not rollover to the next month and is no longer redeemable. Using the development time from past or future months is not permitted.

3. Hosting & Maintenance Plan Terms
Payments
You must pay for your plan in increments of 3, 6, or 12 months.
Please note that refunds are not offered if you choose to cancel your plan before the end of the prepaid period.
I reserve the right to change the monthly price for my services at any time, and I reserve the right to request additional payment on top of the prepaid amount if the monthly price for your plan increases – for example, if you have paid for 12 months at £35/month, but I increase the monthly price with 5 months remaining to £40/month, you would be required to pay a one time additional payment of £25.
A refund for remaining prepaid months will be issued if you choose not to accept a price increase.
Service cancellation
You can cancel your subscription at any time, although you must give one months notice.
Please note that refunds are not offered if you choose to cancel your plan before the end of the prepaid period.
If you cancel your subscription, you are free to migrate your site to your new hosting provider.

Development Time
On applicable plans, you are entitled to one hour of free development time per month, after which any additional website development will be charged at my general rate.

4. Digital Advertising
Payments
You are required to pay the amount spent on advertisement, as well as my service charge (30% of ad spend).
There is a minimum campaign ad spend of £500 (not including service charge).
Payment may be made on a monthly or quarterly basis.
I reserve the right to change the charge for my services at any time.
Service cancellation
You can cancel your campaign at any time; however, if you have yet to reach the minimum £500 ad spend, you must pay the service charge in full that would have been charged for the £500 minimum ad spend.
For example, if you have already paid £200 for the ad spend and £60 service charge and want to cancel your campaign, you’ll need to pay an additional £90.
Termination
By failing to comply with any of the terms & conditions or failing to pay outstanding fees, I reserve the right to terminate or suspend your campaign and my services.
I reserve the right to change, suspend, or terminate any of the services I provide at my sole discretion and without notice.
Upon termination, I have the right to delete all files, data or information associated with the terminated services.

5. Misuse, Illegal or Unethical Use of Services
Illegal, fraudulent or unethical use
If I reasonably suspect that any website, design work, or other service I provide is being used for fraudulent, illegal, or unethical purposes, I reserve the right to permanently suspend or terminate the service immediately and without notice.
No obligation to reinstate
In such cases, I am under no obligation to reinstate the service, even if any outstanding balance is later paid in full.
Outstanding fees
Termination on these grounds does not remove your liability to pay any fees already owed under our agreement, including minimum contract commitments.
Reporting
I also reserve the right to report any suspected fraudulent or illegal activity to the relevant authorities, including (but not limited to) Action Fraud, Trading Standards, or the Police.
